The Criminal Justice (No. 2) (Northern Ireland) Order 2004
(Statutory Instrument 2004 No. 1991, made 27 July 2004, published 6 August 2004, in operation from 28 September 2004) Article 2 provides that a court shall treat hostility based on sexual orientation as an aggravating factor when considering the seriousness of an offence. See also Article 3. The order extends to Northern Ireland only. |

Criminal Justice Act 2003
(2003 c. 44) Section 146 provides that a court must treat hostility based on sexual orientation as an aggravating factor when considering the seriousness of an offence. Section 269(5) and Schedule 21 provide that a court should normally use 30 years as the starting point when determining the minimum term of a mandatory life sentence to be served for a murder that is aggravated by hostility based on sexual orientation (unless other factors call for a whole life order). Section 269 and Schedule 21 came into force on 18 December 2003. Section 146 came into force on 4 April 2005. These provisions extend to England and Wales only. |
